Information Notice concerning the installation or use of combined PLB-AIS devices - Notice No. MCA/O/23-5124

The Malta Communications Authority (MCA) is issuing this notice to inform importers, suppliers, and owners of Maltese registered vessels about the current regulatory position concerning combined Personal Locator Beacon and Automatic Identification System (PLB-AIS) devices.

PLB-AIS devices are intended for use in the maritime environment to transmit distress alerts on the standard PLB frequency 406 MHz and on the internationally designated AIS channels 161.975 MHz and 162.025 MHz. These devices perform a safety-critical function, and any misuse or incorrect configuration may compromise maritime distress and rescue communications.

Currently, no international framework exists governing the use of PLB-AIS devices, including the programming of their identifiers. European and international authorities are assessing the operational and regulatory aspects of these devices to determine the most appropriate way to regulate them, while ensuring that distress and safety communications are fully protected.

In view of these considerations, the MCA has determined that requests for the installation or use of PLB-AIS devices should be withheld. Accordingly, as a temporary measure:

  • PLB-AIS devices are not authorised to be installed or used on Malta-registered vessels;
  • Programming PLB-AIS devices with a Maltese Maritime Identification Digit (MID) is not permitted;
  • Until a specific legal framework is established, PLB-AIS devices remain outside the scope of the General Authorisations (Radiocommunications Apparatus) Regulations (SL 399.40). Their installation or use on Malta-registered vessels constitutes a criminal offence under Maltese law.

Given the safety-critical nature of PLB-AIS devices, the MCA is also formally requesting that all importers and retailers:

  • Cease selling PLB-AIS devices for installation or use on Malta-registered vessels;
  • Apply this measure to both in-person sales and online sales; and
  • For online sales, include a clear written disclaimer stating that PLB-AIS devices are not authorised for use on Malta-registered vessels.

The MCA is closely monitoring ongoing studies on PLB-AIS devices at European and international levels. In due course, the Authority may adopt a national licensing framework appropriate for Malta, which safeguards the integrity of distress and safety communications. Any such framework will be subject to public consultation prior to implementation.

This notice remains in force unless and until the MCA advises otherwise in writing or via its website.
