  1. RESPONSE TO CONSULTATION ON THE POSTAL SECTOR: On the 16th September 2013, the MCA published a consultation paper titled ‘A Postal Authorisation Fee Structure for a Fully Liberalised Market Environment’. The Consultation, which ran through to the 21st October 2013, sought views from the industry and members of the public on the proposed authorisation fee structure. This document provides the salient points of the feedback provided by the respondents to the issues and proposals raised in the Consultation and the MCA’s reflections on the feedback provided.   2. DECISION ON ITEMISED BILLING IN THE FIXED AND TELEPHONY SECTORS: The MCA’s decision specifies the content that both types of itemised bills must contain, as well as the formats in which these bills can be accessed by subscribers should they require such information.   By means of this decision, all mobile and fixed telephony post-paid subscribers can request a basic itemised bill, in either hard copy or electronic format, or a detailed itemised bill, in electronic format, free-of-charge. Legal Update
  1. On the 3rd January 2014, Legal Notice 1 of 2014 was published in the Government Gazette, whereby SL. 254.01 – Postal Services (General) Regulations were amended,  providing  certain changes relating to the fee structure concerning operators authorised to provide postal services.
     
  2. Court of Magistrates: the cases concerning the proceedings initiated against Sesco Investments Ltd. and against Melitanet Ltd. relating to outstanding authorisation dues continued before the Court of Magistrates on the 8th January 2014.
     
  3. Lawsuit Versus GO Plc. whereby GO Plc. are contesting MCA’s regulatory decision published in 2012 regarding Markets 4 and 5. This case is pending before the Administrative Review Tribunal.
     
  4. Lawsuit Versus Global Parcles Ltd. (GPL). GPL are contesting an MCA ruling further to a complaint by MaltaPost, whereby MCA held that GPL require an individual postal licence. The case now stands adjourned for the Tribunal's final decision. This case is pending before the Administrative Review Tribunal.
     
  5. Lawsuit Versus DHL International Ltd. The Administrative Review Tribunal gave a final ruling in the appeal made by DHL International Ltd. confirming MCA’s regulatory decision, whereby DHL were required to have an individual postal services licence.
